Can You Provide for Pets in Your Will?

Our fur babies mean the world to us.  But in the world of Succession Law in Queensland, our pets are considered an asset and not a living creature.

So, can you make provision in your Will for your pets?  Yes - it is possible in Queensland to make provision in your Will for your pets on your death.  This can include gifting your pet to someone.  You may also want to include a lump sum payment of money that can be used by the new owner to care for your pet. 

To better protect your pet, the payment of the money can be made subject to the beneficiary agreeing to look after your pet for a minimum period of time before they can access the money.  Alternatively, some dog breed clubs provide a service of re-homing your pet on your death. This may include the estate paying a small fee for this service.
